Kıdem tazminatı konusu gündemden düşmüyor. Hükümet programında yer alan kıdem tazminatı fonu konusunda ilgili-ilgisiz pek çok bakan üst üste açıklamalar yapıyor, "modeller" açıklıyor. Henüz kamuoyuna açıklanmış ve sendikalara iletilmiş bir hükümet taslağı olmamasına rağmen, kıdem tazminatının dillere pelesenk olması oldukça manidar.
Aslında çalışanlar yavaş yavaş alıştırılmaya çalışıyor. Kamuoyunda "bu iş olacak", "bu iş bitti" algısını yaratılmaya çalışılıyor. En kötüsü bir "kıdem tazminatı sorunu" varmış duygusu yaratılmaya çalışılıyor. Çalışanların cüzi bir kısmının kıdem tazminatı alabildiği fon kurulsa herkesin kıdem tazminatı alabileceği iddia ediliyor. Böylece kıdem tazminatı fonunun aslında işçi yararına olduğu ileri sürülüyor.
Açık söyleyelim: Türkiye’de çalışanların kıdem tazminatı sorunu yoktur. Sadece konuyla ilgili yasaların uygulanmaması, kısaca kanun hâkimiyeti sorunu vardır. Sorun, işverenlerin yasaları çiğneyerek çalışanın kıdem tazminatını gasp etmesine devletin seyirci kalmasıdır. Bunun dışında bir sorun yoktur.
Kıdem tazminatı ile ilgili sorunu olanlar işverenlerdir, işverenler on yıllardır kıdem tazminatını "yük" olarak görmekte ve budanması ve hatta kaldırılması için bitmeyen bir mücadele yürütmektedirler. Meselenin özü budur. İşverenler daha düşük maliyet ve daha kolay işçi çıkarabilmek için, daha fazla esneklik için kıdem tazminatını "sorun" olarak, günah keçisi olarak ilan etmektedirler.
Dikkat edilmesi gereken tehlike, kıdem tazminatının tartışmaya açılmasıdır. "Tartışalım, konuşalım, soruna birlikte çözüm üretelim" yaklaşımı ile kıdem tazminatının bir "sorun" olduğu kabul ettirilmeye çalışılıyor. "Kıdem tazminatını masaya yatıralım, soruna çözüm bulalım" tuzağına düşmemek gerekiyor. Tecrübeyle sabittir, işçiler-sendikalar ne zaman kazanılmış haklarını müzakere etmeye başladılarsa kaybettiler. Bunun somut örneği "sosyal güvenlik reformu" olmuştur. Kıdem tazminatı sendikal hareket için "kırmızı çizgi" olarak korunmalıdır.
Türk-iş Genel Kurulu’nun kıdem tazminatına dokunulması durumunda genel greve gidilmesi kararı aldığı biliniyor. Türk-lş Genel Başkanı Kumlumun 24 Eylül 2011’de Üman-iş£enel Kurulu’nda kıdem tazminatıyla ilgili açıkladığı tutum önemlidir. Türk-iş başkanı kıdem tazminatının kırmızı çizgileri olduğunu ve herhangi bir modelle geriye götürülmesine izin vermeyeceklerini açık bir biçimde söylüyor:
"Bakanlarımız konuşuyor, çünkü kamuoyu kıdem tazminatında yapılmak istenen değişikliklere alıştırılmak isteniyor. Ama biz alışmayacağız arkadaşlar. Kıdem tazminatı işçinin hayalidir, hayallerimizden vazgeçmeyeceğiz… Kıdem tazminatındaki kırmızı çizginiz nedir diye soruyorlar bana… Açık ve net söylüyorum. Kırmızı çizgimiz, kazanılmış haklarımızdır. Aynı hakların hem şu anda çalışanlar için hem de yeni sigortalı olacaklar için muhafaza edilmesidir, itirazımız, herhangi bir modelle bu hakların geriye götürülmesi, budanmasına yöneliktir. 50 yıldır buna izin vermeyen Türk-İş, bundan sonra da vermeyecektir."
Kuşkusuz kırmızı çizgiler konusunda tartışma yapılması abes olur. Türk-iş diğer emek ve meslek örgütleriyle birlikte bu kırmızı çizgiyi savunmak için ortak bir tutum almalı ve bunun gereklerini şimdiden yapmalıdır. Umarız bu açıklamanın gereği yapılır ve kıdem tazminatının kurda kuşa yem edilmesine izin verilmez.
